Welcome to Fabric Coffee! The terms “we”, “us” and “our” refer to Fabric Coffee and Fabric Coffee GmbH. Fabric Coffee operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”).

These Terms and Conditions set out your rights and obligations when using our Services and purchasing products from our online shop.

Please read these Terms and Conditions carefully. By using our Services or purchasing products, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.

1. Scope

These Terms and Conditions apply to all contracts between Fabric Coffee GmbH and consumers (natural persons entering into a legal transaction for purposes that cannot be attributed primarily to their commercial or self-employed professional activities) as well as businesses within the meaning of Section 14 of the German Civil Code (BGB), unless otherwise agreed.

This information is provided in accordance with Section 5 of the German Digital Services Act (DDG).

3. Conclusion of the Contract and Ordering Process

When you place an order, you submit a binding offer to purchase the products in your order.

Important information about the ordering process (Section 312j BGB):

You can only place an order after you have:

  1. Added your items to the shopping cart
  2. Proceed to checkout
  3. Read and accepted our Terms and Conditions and Privacy Policy
  4. Activated the “Pay now” button

The “Pay now” button clearly indicates that you are placing a binding order that requires payment. By clicking this button, you agree to these Terms and Conditions.

Fabric Coffee reserves the right to refuse an order at its discretion for any reason. Your order is only accepted once Fabric Coffee has confirmed acceptance by email. We must receive and process your payment before your order can be accepted.

If we do not accept, modify or cancel an order, we will notify you using the email address provided with your order.

4. Prices, Payment and Taxes

Prices:

All prices shown on our website are final prices and include statutory VAT. Unless otherwise stated, additional shipping costs apply and will be shown in your shopping cart or during the checkout process.

Prices, discounts and promotions may be changed without prior notice. The price charged for a product is the price applicable at the time you place your order and will be stated in your order confirmation email.

Payment methods:

We offer the following payment methods: [insert credit card, PayPal, Klarna, invoice, direct debit, etc.]

You agree to provide current, complete and accurate payment and account information for all purchases. You agree to promptly update your account and contact information so that we can complete transactions and contact you when necessary.

Subscriptions:

You confirm that all information provided when placing an order or registering an account, including payment, billing and account details, is accurate, complete and up to date.

For ongoing subscriptions, you are responsible for promptly updating any changes to your payment and contact details, including changes to your credit card, IBAN, email address, delivery address or billing address. You can do this through your customer account or by contacting us at hallo@fabric.coffee.

If a payment fails because your payment details are outdated or incorrect, we reserve the right to request payment again. Any applicable chargeback or reminder fees may be charged to you.

If you fail to update your payment details when requested, we may temporarily suspend delivery until suitable payment details have been provided. The subscription contract remains in force during the suspension and your payment obligations continue to apply.

We are not responsible for service interruptions, delivery delays or difficulties contacting you that result from outdated or incorrect contact information provided by you.

You must cancel your subscription in writing (email to hallo@fabric.coffee is sufficient) and include your customer number. Cancellation is only considered effectively received if sent to one of the contact addresses most recently provided by you. If a cancellation cannot be delivered because your contact details are out of date, this will not be held against you provided that you have kept your contact details up to date.

5. Shipping, Delivery and Transfer of Risk

Delivery times:

All delivery times are estimates and cannot be guaranteed. We currently ship within Germany only. We roast on Fridays and accept orders until Thursday at 6:00 PM. Orders accepted after Thursday at 6:00 PM will be roasted and shipped during the following production cycle. Once shipped, delivery normally takes 1–3 business days via DHL. Saturday counts as a business day; Sundays and public holidays do not.

We hand your order over to DHL for delivery. You will receive a tracking number by email. We will support you with any issues involving the shipping provider and assist with pursuing any applicable claims.

Shipping costs:

Shipping costs will be clearly displayed before you complete your order.

Transfer of risk:

Once we have handed the goods over to the shipping provider, the risk of loss passes to you. We are not responsible for delays caused by the shipping provider, customs clearance or circumstances beyond our control.

Refused or uncollected deliveries:

If you refuse delivery or fail to collect the shipment, you remain responsible for payment of the order.

6. Right of Withdrawal (Consumers)

Information about your right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us, Fabric Coffee GmbH, Odermannstraße 1, 04177 Leipzig, Germany, email: hallo@fabric.coffee, of your decision to withdraw from the contract by means of a clear statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but this is not mandatory.

Effects of withdrawal:

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal.

We will use the same payment method for the refund that you used for the original transaction, unless we have expressly agreed otherwise with you. You will not be charged any fees for the refund.

We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You are responsible for the direct cost of returning the goods.

Exclusions from the right of withdrawal:

The right of withdrawal does not apply to contracts for:

  • The supply of goods that are not prefabricated and are made to the consumer’s individual specifications
  • The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene once their seal has been removed after delivery

7. Warranty and Liability

Statutory warranty:

We are liable for defects in accordance with Sections 434 et seq. of the German Civil Code (BGB).

Food safety:

All our products are inspected for foreign objects. If you nevertheless discover a foreign object (such as a stone or metal particle) in your package:

  1. Please stop using the product
  2. Contact us immediately
  3. We will refund the purchase price and replace the product

For damage to coffee equipment, we will assess each case individually in accordance with applicable statutory provisions.

Limitation of liability:

Our liability is governed by applicable statutory law (Sections 434 et seq. BGB, German Product Liability Act (ProdHaftG)).

Exclusion of statutory warranty rights:

Any exclusion of statutory warranty rights in relation to consumers is not legally effective and will therefore not be applied.

Damage in transit:

If your order arrives with visible damage caused during transit, please report the damage to the DHL delivery driver immediately and contact us without delay at hallo@fabric.coffee.

Important: Failure to report such damage has no effect whatsoever on your statutory warranty rights. You can report a defect at any time, and we will review each case individually.

Reporting the damage to the shipping provider nevertheless helps us pursue any claims we may have against the carrier or transport insurer. This will not put you at any disadvantage.

8. Retention of Title

The goods supplied remain our property until the invoice amount has been paid in full (Section 449 BGB). Business customers are entitled to resell the goods in the ordinary course of business. We reserve the right to extend retention of title to claims arising from the processing or combination of the goods.

9. Intellectual Property

Our Services, including all trademarks, text, images, graphics, product reviews, videos and designs, are owned by Fabric Coffee, its affiliates or licensors and are protected by copyright and other intellectual property laws.

These Terms permit you to use the Services solely for your personal, non-commercial purposes. You may not reproduce, distribute, modify or publicly display any of our materials without our prior written consent.

The names, logos and slogans of Fabric Coffee are trademarks of Fabric Coffee or its affiliates. You may not use these trademarks without prior written permission.

10. Third-Party Links and Services

Our website may contain links to third-party websites, such as our social media profiles or partner websites. We have no control over the content of these websites and do not actively review them.

Your use of third-party websites is at your own risk. We recommend that you review the privacy policies of the respective providers before using their services.

11. Shopify

Fabric Coffee is powered by Shopify, which enables us to provide the Services. However, all sales and purchases made through our shop are directly between you and Fabric Coffee GmbH. By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Fabric Coffee. You expressly release Shopify and its affiliates from any claims arising from or relating to your purchases.

12. Privacy

As the Services are hosted by Shopify, Shopify collects and processes personal data relating to your access to and use of the Services. Further information about how we, Shopify and our partners use your personal data can be found in our Privacy Policy.

13. Feedback

If you send us ideas, suggestions, feedback or other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce and publish that feedback for any purpose.

14. Prohibited Uses

You may only use the Services for lawful purposes. In particular, you must not:

  • Upload viruses or malicious code
  • Reproduce or resell any part of the Services
  • Collect personal data belonging to others
  • Use spam, phishing or automated access methods such as bots or scraping

We reserve the right to suspend or deactivate your account if you breach these restrictions.

15. Termination

We may terminate this agreement or your access to the Services at our sole discretion at any time and without prior notice. You remain responsible for all amounts due up to the date of termination.

The following sections will continue to apply after termination: Intellectual Property, Liability, Indemnification, Severability, Governing Law and Privacy.

16. Indemnification

You agree to indemnify and hold harmless Fabric Coffee, Shopify and our affiliates from any losses, damages, liabilities or claims arising from your breach of these Terms or applicable law.

17. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will remain enforceable to the fullest extent permitted by applicable law, and the unenforceable part will be deemed severed. The validity of the remaining provisions will not be affected.

18. No Waiver; Entire Agreement

Our failure to exercise any right under these Terms does not constitute a waiver of that right. These Terms constitute the entire agreement between you and us and supersede all prior agreements.

19. Assignment

You may not delegate or assign this agreement without our prior written consent. We may assign these Terms without your consent.

20. Governing Law and Jurisdiction

Consumers in the European Union:

Contracts with consumers in the European Union are generally governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Consumers nevertheless retain any mandatory rights granted to them under the laws of their country of residence, particularly applicable consumer protection laws.

Place of jurisdiction:

The place of performance for all deliveries and payments is Leipzig, Germany.

To the extent permitted by law, Leipzig, Germany, shall have exclusive jurisdiction over all disputes arising from or in connection with this contract. Consumers may alternatively bring proceedings before the courts of their place of residence.

The most current version of these Terms and Conditions is always available on this page.

We reserve the right to update parts of these Terms at our discretion. We will notify you of any material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice.
